摘 要:综合开发地铁建设资源可以为地铁建设筹集资金,并实现资源的集约化利用,避免重复建设。然而地铁建设资源开发却遇到了重重法律障碍。通过分析我国现行地铁建设资源开发配套法律体系存在的不足,建议在地铁地上空间资源方面需对土地收购储备制度、交通用地和经营性土地联合开发、"轨道+土地"运营模式等方面完善法律支持条件。在地下土地空间资源方面,明确国家依法实行国有地下空间有偿使用和有限使用的制度;使用权出让引入三维界定方法;明确地下空间开发相关主管部门;制定维持管理法规等。在土地增值方面需完善土地出让金制度、土地税收制度和设立专项费用制度等。Metro construction resource is an informal name for sane tangible and intangible resources directly or indirectly brought about by subway construction and is the value shift and value proliferation of the investment for subway. In general,metro construction resource inclues the value increase of the surrounding land, the ground and underground space resources. Although metro constructioin has entered the stage of rapid development, a set of legal systems to guide and regulate the comprehensive development and utilization of subway construction is still missing. This paper points out that the comprehensive development of metro construction resources can raise funds for subway construction,realize an intensive use of the related resouroes avoid duplication and achieve the sustainable development of the sodety. Since metro development has enocuntered numerous legal obstacles in China,after analyzing the shortoomings of the surrent legal system that supports the development of metro construction this paper gives the detailed measures and proposals from aspects of the underground space resources the ground spece resources and the valus increase of the surrounding land.
