台湾犯罪被害人补偿制度评析

摘　　要：台湾1998年创设了犯罪被害人补偿制度,意欲通过这种社会福利性质的制度,以社会保险分散风险的方式,来达成当局保障人民基本权利的任务,并借以达到促进犯罪防治及社会部分控制的附带目的。台湾犯罪被害人补偿制度的设计吸收了其它国家及地区的优点与实施上的缺失,因此有些制度内容具有领先性。然而该制度在现实运行中出现了一些误解和偏差,台湾的有识之士目前也正在积极探讨,力图寻求制度的理性变革,从而建构一套理性的犯罪被害人"司法"保护的完整体系。The compensation system for crime victim was established in Taiwan in 1998.The desire is to accomplish the authority＇s duty of safeguarding the people＇s basic rights and achieve supplementary goal of promoting crime prevention and social part controls by this kind of the system of social welfare and the way of social insurance to relieve the risks. The design of Taiwan＇s crime victim compensation system has absorbed the advantages and the implementation missing of other countries and regions, therefore some system content is in the lead. However this system presented some misunderstandings and the deviation in the reality operation, the people of insight in Taiwan are discussing and trying hard to seek the rational system change at present so as to build a set of rational and integrity system of judicial protection for crime victim.
