摘　　要：在日常生活和刑事侦查、刑事审判中,电子形式的图像证据已经成为主流,因而应对这种与传统图像证据截然不同的新兴证据形态,必须从证据规则、证明过程等角度进行全新的探索。图像电子证据的证据能力和证明力的认定,具有鲜明的技术特征,为证据规则和刑事证明的理论提供了新鲜的内容。Digital images now become the mainstream of criminal investigation, criminal trial as well as daily life. As digital images make its way into the courtroom, a new research should be done into the rules of proof and process of proof. It is important to ensure that their credibility and the determination of weight of proof are not lost in the embrace of new technology. With distinct technical traits, evidence of digital images greatly differs from traditional images and thus provides fresh contents for the theories of rules and authentication of proof.
