从国际投资头寸表看中国的国际投资立法

摘　　要：美国次级债风暴迅速席卷全球,灾难空前,这次风暴充分说明经济国际化高速发展、国际投资规模不断扩大和国际资本流动加剧的同时,导致各国经济面临的风险性、不确定性增大;为此,编制一个完整的国际账户体系如国际投资头寸表,对风险进行衡量和控制,尤为必要。本文拟探讨国际投资头寸表反映出的中国国际投资立法存在的问题,如我国的国际投资立法不能优化配置资源、没有明确债务证券投资比例等问题,提出了通过投资立法鼓励中国对外的股本证券投资、减少对外的债务证券投资、完善国际收支立法以提高外汇储备资金的管理效率等解决措施。US Subordinated Debt turn,oil, as an unprecedented disaster, sweeped across the world rapidly, which has fully showed high - speed international economic development, constantly expanded investment and intensified capital flows, meanwhile, it caused more risk and uncertainty for economy. To the end, it becomes essential to prepare comprehensive international accounts such as IIP table to measure and control risks. This paper reflects international investment legislation of China for this issues, for example, our legislation can not optimize resources distribution and with no clear investment ratio of debt or security, at last, to encourage our foreign investment for equity securities, reduce external investment for debt and securities, improve the international balance of payments legislation, doubtless, they can boost management efficiency of foreign exchange reserves and other financial solutions.
