摘　　要：我国现行刑法设置了68个死刑罪名。学界减少死刑或废除死刑的呼声不断高涨,有学者在学术研究中还列出了废除死刑的时间表。死刑立法的最终根基在民意。对现有死刑罪名应当如何理性设置进行了民意调查,分析了其中的原因,提出了死刑罪名逐步减少直至废除的立法建议。There are 68 death penalty charges in the Criminal Law of our country. The voices ot reducing or abolishing death penalty run high constantly in academic circles some scholars in academic research have listed the time table abolishing death penalty. The final foundation that death penalty legislates is based on public will. According to opinion polls about how to set up death penalty charge rationally, we analyze the reasons, and then put forward the legislative proposal that is to reduce until abolishing death penalty charge progressively.
