摘  要:采用实证分析法、比较分析法、逻辑分析法和语义分析法,在总结相关规范性法律文件的规定及其变化、司法审判实践情况以及理论界有关该问题的争议的基础上,分析了交通事故责任认定的特征及其与鉴定行为的区别,得出交通事故责任认定应是公安机关行使行政管理职权的具体行政行为,应该纳入行政诉讼范围的结论。从立法、司法、理论方面全面研究该问题,意在充实相关问题的理论研究,并希望通过本文论述推动有关立法,实现行政实务和法律规定的衔接,制约公安交警部门的行政权力,促使交通事故当事人权益得到充分维护,实现真正的依法行政。Upon adopting such researching methods as empirical analysis, comparative analysis, logical analysis and semantic analysis, this paper makes a summary about the relevant statutory provisions and the changes in the provisions, the judicial trial practices and the main arguments of the scholars a- bout it. On basis of those, the paper analyzes character of the confirmation on the liability of the traffic accidents and the differences between this confirmation and the act of authentication and concludes that the confirmation on the liability of the traffic accidents should be regarded as a kind of specific admin- istrative act which is conducted by the public security organs through performing their duties and func- tions in administrative management and that the confirmation should be accepted into the trial scope of administrative court. This paper makes an overall research about the issue through legislation, judicial practices and theory with a purpose of deepening the theoretical research and promoting the relevant legislation on the issue. On basis of that, the administrative practices and the law provisions can link up and the administrative power of the public security organs will be restricted and the right and interest of the parties in traffic accidents will be safeguarded in full so that the rule of law in administration can virtually be achieved.
