再论安全保障义务人的补充责任

摘　　要：在第三人实施侵害行为的情形下,由安全保障义务人承担补充义务的规定违背侵权法的基本精神,与先进国家的做法相悖,且不符合设立安全保障义务制度的初衷。故因第三人侵害导致损害结果发生的,安全保障义务人与实施侵害行为的第三人应按各自过失大小或原因力的比例承担相应的赔偿责任,但不排除在某些情形下,安全人保障义务人与侵害人承担连带责任。When the third person conducts a trotious act, the provision of the safety - guard obligor＇s complementary liability disobeys the fundamental spirit of the tort law, goes against the practice of the advanced countries and can＇t conform to the original intention of establishing the safety - guard duty. So the obligor and the torffeasor should take relevant responsibility according to the proportion of their respective fault or causal force. And in some circumstances, the obligor and the torffeasor may take the joint liability.
