论行政案卷排他原则的运作原理——正当行政程序的保障机制

摘　　要：行政案卷排他原则的运作必须以下列三个条件为前提,即保障相对人主体地位的正当行政程序,由客观事实到法律事实,看得见的程序真相。在此基础上,行政案卷排他原则通过排斥正当程序以外的因素对行政行为起作用,同时过滤、净化程序中的事实因素和法律因素,从而避免行政程序成为一种形式、摆设,甚至是骗局,最终保障行政行为是程序自然而然的结果。同时,案卷排他也使相对人的程序权利得以切实行使,并使相对人行使的程序权利延续到行政行为中,从而使相对人的主体地位和人格尊严得以实现,相对人的程序权利得以保障。The operation of administrative file exclusive principle shou conditions, namely, securing the proper administrative procedure of person; developing from objective reality to legal reality, and ensuring be based on the e subject status e visible truth of lowing three the relative e procedure. Based on those, the administrative file exclusive principle, by excluding the elements beyond the proper procedure, has an effect on the administrative behavior while filtering and purifying the factual elements and legal elements in the procedure so as to prevent the administrative procedure from becoming a form, a decoration or even a fraud. As a result, the said principle is to make sure that the administrative behavior is the natural consequence of the procedure. At the same time, file exclusion will secure the implementation of the procedural rights of the relative person, and extend the said procedural rights into the administrative behavior, which then accords the relative person the subject status and personal dig and secures his procedural rights.
