摘　　要：前科消灭制度作为一种人为构建的法律制度,遭受着民意和法意的双重诘问。在我国,未成年人前科消灭制度在司法实践中遇到许多困境,以被告人、国家公权力为视角结合域外的司法实践来考察,设立未成年人前科消灭制度有其必要性和可行性,它顺应了社会发展的需要,体现了恢复性司法的宽容和人文的关怀。As a human construction,＂ elimination of criminal record from juvenile delinquency＂ was suffering many doubts from the theory and the reality. The author holds that the legal construction accords the value of legal justice , benefits the purpose of penalty and helps rip the crime label from the minor. So it is necessary to build up the system and expand it with enough preparation.
