从属专利兼容性与基础专利许可费关系研究

摘　　要：在考虑间接网络外部性的基础上,通过经济学模型分析,揭示出从属专利战略中兼容性对基础专利许可费的影响机理。分析表明,从属专利的不兼容性会促使基础专利之间为了争夺间接网络外部性效应而展开许可费价格竞争。从属专利研发者都选择不与竞争性基础专利兼容是为取得较低基础专利许可费的占优战略均衡。Considering the indirect network externality, the authors explore the affecting mechanism of subservient - patent compatibility on the dominant - patent royalty through economics model. It shows that the incompatibility of subservient patent can promote the price competition among dominant - patent licensors in order to contend for the indirect network externality. Incompatibility strategy is the dominant - strategy equilibrium for companies developing subservient- patents technologies
