摘 要:新颖性要求申请专利的发明创造必须是新的、前所未有的,其目的是阻止对公众已经得到的技术授予专利权,避免公众获得并使用已知的技术知识的权利受到限制。判断新颖性的一般规则对判断生物技术领域里的发明同样适用,只是生物技术发明专利的新颖性判断有其一定的特殊性。生物技术领域里发明的新颖性问题往往与可专利性问题紧紧地联系在一起。对于基因专利的新颖性而言,其特殊性在于,基因序列片段的长短对新颖性判断并没有影响,并不能因为已经存在较长的基因序列就否定较短的基因序列的新颖性,反之亦然。An invention must be new and unprecedented, so much so that it must be novel enough to be a patent candidate. Its purpose is to prevent the technology which has already been ohtained by the public being awarded patent, and avoid the public being restricted in their use of the known technical knowledge. The general rule of novelty judgment is equally applicable to biotechnological inventions, except that the criterion for judging the novelty of biotechnological inventions has some special features. The novelty of bioteehnologieal inventions is always closely associated with the patentability of biotechnological inventions. Concerning the novelty of the genetic sequence, the factor to be considered is that the length of the genetic sequence has not affected the novelty judgment, and thai the novelty of the shorter genetic sequence should not be denied because of the existenee of the longer genetic sequence, and vice versa.
