警察权运行的现状与完善:基于宪政理论的框架分析

摘　　要：宪政理论对我们重新界定警察权、规范和完善警察权的运行具有很大的理论价值和方法论意义。宪政框架下的警察权应该是法治的、有限的、廉洁高效的和透明的,但现实中的警察权在运行中存在着定位不准、监督不力,绩效评估制度不完善的困境。宪政框架下警察权完善的途径与目标:建设宪政民主;加强党的执政能力建设;警察权的重新定位;合理的绩效评估制度;构建社会主义和谐社会。Consfitufionalism has high theory value and methodology meaning for defining police power, standardizing and improving operation of police power. Police power under the frame of constitufionalism should be governed by law, limited, clean and high- efficient and transparent, but reality it is in a difficult situation of inaccurate location, weak supervision and incomplete appraisal system of peffomaanee Routes and goals with complete of police power under the frame of constitufionalism were to build democracy of constitutionalism; strengthen the construction of administration ability of the party; relocate police＇s power; establish rational performance appraisal system; construct the socialist harmonious society.
