摘　　要：私法是法治的真正基础,私法精神的缺失是我国目前法治建设中的瓶颈。为了构建私法精神、促进我国的法治建设,我国应扩展社会自治领域,增强公民权利意识,加强有关私法的立法。The private law is the real foundation of rule by law. The inefficient of spirit of private law is the most important problem in the construction of the law in China. In order to construct the spirit of the private law and improve the construction of the law, China should expand the field of autonomy, improve the consciousness of the citizen＇s right, and reinforce the legislation of the private law.
