摘 要:《劳动争议调解仲裁法》的颁布是对我国现行的劳动争议处理制度进行的大胆改革,有效地解决了我国现行劳动争议处理过程中存在的争议处理周期过长、申请仲裁时效过短和争议处理成本过高等问题。但是该法仍未彻底改变我国现行"一调一裁两审"的劳动争议处理程序。由于我国劳动争议案件程序上设置的不完善,在某种程度上,反而使当事人无法利用法律来捍卫自己的权利。本文试图通过介绍我国劳动争议案件程序及缺陷,提出制度重构的设想。The promulgation of Law of Mediation and Arbitration of Labor Disputes is the daring reform in the current labor dispute processing system. And it effectively solved some problems in processing our labor dispute cases, such as the long time period for processing, short prescription foe arbitration, high cost and so on. However, it can't completely change our current processing procedure of one mediation, one arbitration and two instances. Because of the imperfection in the procedure setting in labor dispute, to some extent, it makes the clients unable to protect his or her right by law. The paper put forwards the concept of system restructuring through introducing the procedure for our labor dispute processing and its limitation.
