联邦主义的宪政诉求——以1922年湖南省宪为例

摘　　要：在中国近代宪政运动中,代表联邦主义宪政的湖南省宪以其分权制衡、地方主义和倚重民权的宪政理念、制度设计,显示了联邦主义者寻求建立民主、稳定、统一的宪政国家的宪政诉求,其进步、合理成份应当肯定。而联邦主义与近代中国国情相背离的国家结构观和制宪技术的某些局限则值得反思。In modern Chinese movement of constitution, the Hunan provincial contitution, which represented the constitution of unionism, revealed the unionists＇ seeking for building a democratic, stable and unity constitutional country. The characteristics of Hunan provincial constitution focused on decentralization of power, localism and prefering civil rights concept and system designing. Therefore, the progress and resonable elements should be affirmed. But the unionism＇s concept of state structure, which failed away modern China＇s situation, and some limitation of skills in making the constitution need us to think about it.
