关于农村民间金融法律规制的思考——以“软法”之治为视角

摘　　要：农村民间金融的发展对农村经济的发展有着至关重要的推动作用,但在国家正规金融垄断格局下,由于缺乏政府监管与法律制度的规范,我国农村民间金融发展始终处于混乱和被国家"限制"与"叫停"的状况。本文以"软法"之治的视角来分析农村民间金融中的"软法"现象,并提出了规范农村民间金融发展的路径选择以及农村民间金融"软法"的转化。The development of rural nongovernmental finance plays a crucial role in promoting rural economic development, while which is in disordered situation and is restricted and suspended for lack of governmental and legal regulation in the monopoly of formal finance framework. From the perspective of ＂soft law＂ governance, ＂soft law＂ phenomenon of rural nongovernmental finance is analyzed and the proposals about the choice of the path of rural nongovernmental finance and the transformation of ＂soft law＂ of rural nongovernmental finance are put forward.
