摘　　要：现代科学技术的发展在人类社会中起着举足轻重的作用,带来人类丰富物质文明的同时,也带来了伦理的困惑与精神的失落。科技发展呼唤法治,法治则以伦理学为道德基础。没有伦理的指导,科技发展就失去了方向,制度建构也丧失了基础。功利主义作为重要的一种伦理学流派,对现代社会起着重要影响,其理论可为科技立法提供思想资源。古典功利主义发展至今,其优势和缺陷都为科技立法带来了启示。The development of modem science and technology is playing important role in the human society, bringing the humanity rich material civilization, and at the same time also bringing ethics puzzled with spiritual losing. Technical development summons government by law, and government by law takes ethics as its moral foundation. Haven＇t the instruction of ethics, science and technology development will lose the direction, and the system construction will also lose the foundation. Utilitarianism is one of the important ethics schools and gets up the important influence to the modem society. Its theory may provide the resources for the technical legislation.
