摘　　要：近年来,有关侵犯死者名誉的案例时有发生,虽然对于死者名誉需要保护这一点少有异议,但有关保护死者名誉的理论根据却众说纷纭。人死后是否还享有权利,是否还有人格利益?我国现行法律保护的是死者人格利益,还是生者身份权益?从我国现实情况看,保护死者人格利益就是保护死者亲属人格权益。The interpretation of the stipulation about the reputation of the dead is different from the judicatory practice, that is, legislation protects the reputation of the dead, rather than the right of reputation. Legislation should clearly define the reputation before death and the interest from the reputation. This pn^tection is essential to protect the reputation interest, not the reputation after nor before the death.
