法官角色的理性化分析与诠释

摘　　要：在新的历史时期,法官应当不断提高自身的政治素质、业务素质和职业道德素质,以转变角色、严格执法,提高司法的可信度与公信力。法官角色主要包括司法角色、社会角色、行政角色。应建立以司法角色为核心,社会角色为辅助的法官角色定位体系,并兼顾行政角色的功能。法官司法角色与社会角色的承担有一定的层次性或差异性。法官角色转变应坚持以实现司法公正为终极目标,以实现审判的社会效果与法律效果的统一。Judges need continually to improve their political, professional, and moral qualities by prop- er roles and fair administration of the law in order to enhance the credibility of the law. The roles of judges mainly include judicial, social, and administrative roles, with the judicial role as the center. The judicial and social roles differ in levels, the previous of which should aim at the ultimate legal justice as the unity of the social and legal properties of the trials.
