摘　　要：美国欠缺行为能力成年人之关系权学说经过多年的发展日趋完善。鉴于我国高龄智障者日益增多,我国仅限精神病人为成年监护的对象,完全无法利用该制度保护其利益。现行条文不仅不能解决所有问题,且法律条文规定过少,非常有参酌外国立法修正本国立法的必要。The theory of relationship rights of incompetent adults in the U.S. is becoming more and more mature with many years＇ development, but we cannot employ the guardianship system to protect the interests of the growing number of elderly mentally retarded persons because the system is only for mentally disabled adults in China. There are not enough legal provisions for us to solve all the problems, so it is very necessary to modify our laws in this respect with reference to relevant foreign legislation.
