摘  要:治安承包是公共行政民营化浪潮在当下中国特定行政领域中的制度表征,相关争议的焦点在于公共行政民营化界限的判断。国家职能、行政过程及法律保留是影响民营化界限的三大主要因素。以合同承包为代表的形式民营化举措并未改变政府责任,能够得到广泛运用;以政府撤资为代表的实质民营化举措导致政府责任的移转,仅适用于需要完全市场化的公共行政事务;介于两者之间的政府淡出形式,可以在政府占垄断地位的行政事务范围内广泛采用。The contract for undertaking public security is the system attribute of Chinese specific administrative domain in the public administration privatization tide nowadays.It's related disputes focus on the judgment of public administration privatization boundary.The state function,the administrative process and the legal retention are the three main factors which influence upon dividing the privatization boundary.The contract for undertaking public administration has not changed the government responsibilities which can be modeled.Disinvesting of the government will result in the shifting of responsibilities,which is only suitable for some public administrative affairs that need operating completely in market.The third fade-out way which lies between the above mentioned two could find vast use in administrative affairs monopolized by government.
