摘　　要：随着改革开放的不断深入,我国的经济和社会发展都取得了长足的进步,同时医疗卫生事业也取得了重大进展,但近年来,医患关系不断恶化,已经成为影响我国构建和谐社会的一大因素。本文从分析我国医患关系紧张的法律原因入手,具体分析我国存在的医患法律关系,医疗纠纷的法律适用等法律问题,提出以保护医患双方利益为目的、重构和谐医患关系的法律新机制。With the developing of the reform, our country gets long progress in economy, as well as the medical and public health. But in recent years, doctor-patient relationship has getting deteriorated, which has become one of the important influencing factors in constructing harmonious society in China. By summarizing the legal causes of tension relationship between doctor-patient, legal relationship between them, and application of law in medical disputes, new law mechanism have been put forward to protect and reconstruct the doctor-patient relationship.
