摘　　要："三农问题"的核心是农民的权益问题,农民权益尤其是平等权的缺失是造成"三农问题"的法律根源。宪法作为国家的根本大法,必须在宪政层面上保护农民的平等权。The core issue of, three diinensional rural issues is the rights and interests of peasantry. The root of the law works three dimensional rural issues is the rights of peasantry, especially lacking of the equal rights. The constitution as a root law of a nation, which is the basic law of criterion and System. Therefore, we should be protected the equal rights from constitution.
