摘　　要：高校学生——大学生群体已经成为社会群体中的一个重要组成部分,因高等学校学生基本上均为成年人,同时扮演着具有完全民事行为能力的社会人和在学校相当职权监管下的学生,其双重身份较为特殊,构成独特的大学生群体。然而大学生群体中发生的伤害事故也因其双重身份具有一定的特殊性,其中,学校责任的确定就是一个比较复杂且不能回避的现实问题。本文旨在通过对高等学校学生伤害事故的法理和司法实践进行分析,以期找出高等学校学生伤害事故学校责任确定的最佳途径,明晰学生伤害事故中的法律关系。College students, basically adults, have become an important component or social groups. Jneir dual identity, a citizen with full civil capacity and a student under the supervision of the university, is special and makes them a unique ＇university group＇. Therefore the students＇ injury accidents are special as a result of their special identity. How to determine the college＇s liability is a complex and unavoidable problem. This paper analyzes the legal and judicial practice, in the hope of finding the best way to ensure the college＇s liability, and make clear the legal relations in students＇ injury accidents.
