摘　　要：国际奥委会在瑞士国内法上是一种私法性社团法人,其在瑞士国内享有一定的特权和豁免。在奥林匹克大家庭中,国际奥委会处于领导者、组织者和纠纷裁决者的地位。在传统国际法学理论上,国际奥委会是否具有国际法主体资格,一直存在争议;从私国际法的观点以及国际习惯来看,国际奥委会应当具备国际法主体资格。International Olympic Committee（IOC） is one of the public juridical associations in Swiss law, and it enjoys some privilege and immunity in Switzerland. In the Olympic family, IOC is the leader,organizer and arbitrator for Olympic Movement. There are debates about the subject competence of IOC for International Law, but from the perspective of ＂Internationa Law in Private＂ doctrine and the international custom, it should possess the subject status in International Law.
