摘 要:港口建设投融资的法律环境对于港口发展具有引导意义,但在法律构架和制度安排方面却长期滞后。以天津港建设历史和现状为出发点,结合天津港发展的新契机,通过回顾中国港口投融资制度在《港口法》颁布前后的发展历程,全面梳理现阶段中国港口建设的投融资法律环境,并着重研究天津港地方投融资法律政策。法律分析结果表明,《港口法》增强了地方港口经营者投融资的独立权力,对于中国港口业的发展具有积极影响,但在港口产业投融资规制和港口建设竞争协调机制方面还存在制度缺失。The legal circumstance of port investment and financing has guiding significance on the development of China's port industry though it is still under construction in aspects of system implementation and legal framework. Taking Tianjing port's constructing history and present situation as starting point, combining with the new opportunity for Tianjing port' s development, the paper discussed the current legal circumstance of port investment and financing by reviewing the developing process of China's port investment and financing system before and after the issuing of the Port Law of PRC, emphatically studied the legal investment and financing legal policies of Tianjing port. Legal analysis shows that the Port Law of PRC has strengthened local port operator's independent power of investment and financing, which has positive effect to develop port industry of China. However, the institutional insufficiency is still remarkable in protective regulatory scheme of port industry as well as the coordinating mechanism on competition of port construction.
