比较视野下的中国传统侦查文化论纲——兼论中国传统侦查文化的特征

摘　　要：在中国古代文明孕育出荦荦大端的传统侦查文化的同时,东西方其他古老文明也培育出了精彩纷呈的侦查文化。在比较法律文化的视野下,与其他国家不同历史时期的侦查文化对比之中,我们更可以发现中国传统侦查文化具有以下特征:中国传统侦查充溢着关切人的"民本主义"色彩;"专制集权"构成中国传统侦查文化的根本品质;传统侦查文化中充斥着"工具主义";中国传统侦查非常注重经验的积累,并发展起较为丰富的传统侦查措施体系和谋略体系。中西方传统侦查文化的嬗变既有殊异,也有共通之处,它们的嬗变过程为中国传统侦查的现代转型提供了镜鉴。In ancient China, Chinese civilization has nurtured gracious traditional criminal investigation culture. In East and West, other ancient civilizations have nurtured brilliant cultures of the traditional criminal investigation. In comparative perspective, we can understand easily that Chinese traditional criminal investigation culture is special. The culture has the following characteristics： embody people-based doctrine, in order to guarantee the monarch sovereign embody, embody ＂law as tools doctrine＂. And Chinese ancient judicial officers paid too much attention to the criminal investigation experience rather than science. In the field of Chinese traditional criminal investigation, the systems of measurements and strategies were developed rapidly. There were some distinct on the culture evolutions of ancient Chinese and Western traditional criminal investigation. But there were some common evolution experience. The process of their evolution benefits modernization of Chinese criminal investigation system.
