摘　　要：网络的出现与发展,对未成年人监护制度提出了新的挑战。建立未成年人的网络空间监护制度,是网络空间性质的使然、未成年人特质的必然、人权保障的应然。然而,网络的安全正成为影响未成年人成长日益突出的社会问题,其问题的法律追问,是网络监护人的缺位、法律制度的缺陷、责任落实的缺失。因此,建立我国未成年人的国家、社会、家庭网络监护法律链已刻不容缓。The advent and development of the Internet has presented new challenges to the guardianship system of minors. The establishment of the minors＇cyberspace guardianship system is the result of the nature of cyberspace, of the minors＇features and of the protection of human rights. However, the security of network is becoming an increasingly prominent social issue affecting the growth of minors, whose legal enquiry is the ab- sence of a network guardian, the deficiency of legal system and the lack of responsibility implementing. Therefore, it＇s urgent to set up the minors＇legal guardianship network of the nation, the society and the family.
