摘　　要：从理论研究、原型项目与试验系统建设、实际应用项目建设等三个角度概述了我国数字图书馆十多年来的研究与建设成就,并分析著作权例外是个体利益与公共利益的平衡点。同时,从我国著作权例外规定缺失、著作权法律例外规定缺乏灵活性以及存在模糊性等方面指出数字图书馆享有的著作权例外空间较为窄小、模糊,从而导致数字图书馆的著作权侵权风险依然存在。在此基础上,深入剖析了明晰、扩大数字图书馆享有的著作权例外空间的迫切性。The paper summarizes the performance of research and construction of digital library undertaking in recent ten years in China from the aspects of theory study, pilot projects, as well as miscellaneous projects, points out that exception of copyright law is the balance between personal interest and public interest. Meanwhile, brings forward that the exception of copyright applied in digital library community is narrow and fuzzy from the aspects of the lack, unclearness and inflexibility of exceptions of copyright law in China. On this basis, it deeply analyzes the imminence to clearly define and farther expand the exception of copyright applied in digital library community.
