摘　　要：宪法是人权的保障书,其主要功能之一是为了保障人权,而人权保障要真正得以实现则依赖于宪法和宪政制度的构建与完善,其中违宪审查是现代宪政国家保障人权不可或缺的基本制度,违宪审查是实现宪法对人权的保障功能的重要途径。违宪审查和人权保障相互之间存在着密切的学理关联,只有通过实施宪法、确立违宪审查制度才能真正实现宪法的人权保障功能。Constitution is the guarantee of human rights and its main function is to protect human fights. The genuine realization of human rights protection depends on the establishment and perfection of a series of constitution and constitutionalism system. Constitutionality investigation is an indispensable system and important way to realize the function of human rights protection of constitution. There is a close relation between constitutionality investigation and human rights protection. Only by means of carrying out constitution and setting up the system of constitutionality investigation, can we realize genuinely the function of human rights protection of constitution.
