西原春夫“国民欲求”概念之展开——兼论其对我国刑事法治的指引作用

摘　　要：日本著名的刑法学家、教育家、社会活动家西原春夫先生在其《刑法的根基与哲学》中,通过对以欲求为中心的人类行为科学的探讨,将刑法的根基归结为"国民的欲求"。"国民欲求"的特征在于其道德性和个人法益保护性,所以对其认定是一种相对主义的价值判断。作为刑法根基的"国民欲求"必然对刑事法治起到很大的指引作用。In Foundation and Philosophy of Criminal Law, through the study of the science of human action, Mr. Haruo Nishihara regarded ＂national desire＂ as the foundation of criminal law, which is mainly about human desire. The characteristic of ＂national desire＂ lies in its moral and personal interests protecting standard, so it is a relative value judgment. As the foundation of criminal law, ＂national desire＂ plays a direct role in the rule of criminal law.
