福建省公安民警执法权益受侵与维护情况分析

摘　　要：从统计数据看,当前侵害公安民警执法权益的行为主要有暴力袭警、恶意投诉诬告等形式,因此,使大量的公安民警身心受到伤害。在现行的法律与行政框架下,维护公安民警执法权益有两条途径,即追究侵害公安民警执法权益者法律责任与对权益受到侵害的民警予以相应的权益救济。从调研的情况看,侵害公安民警执法权益案件的发生与特定区域内的社会治安形势、经济发展,警察数量的配置以及外来人口数量之间存在一定的关系。From the statistics, the major forms of violating the police＇s rights and interests of law enforcement include acts of violent assaulting, malicious and false charge , it caused physical harm to a great deal of police officers. Under the current legal and administrative framework, The way to safeguard the police＇s rights and interests of law enforcement are two, that is to find out the violator＇s responsibility and give some limited relief to the infringed police. According with the facts found in the investigation, we can argue that there is certain relationship between violating the police＇s rights ＆ interests of law enforcement and the public order, economic situation, the number of police deployment, as well as the number of nonnative population in a specific area.
