摘　　要：我国的公安民警权益保护制度经历了初步形成、大力发展和全面推进三个阶段,沿着从行政调整到法律调整、从以权力保护权益到以责任保护权益、从授予权利(权力)到提供救济、从事后保护到事前保护、从内部保护到社会保护、逐渐实现向机构化和专业化保护的方向发展。但尚存在许多不足,从法律渊源上看,立法层次低,规范分散,因此宜统一立法,制定《人民警察权益保护条例》;从立法内容上看,尚存诸多缺漏,缺乏可操作性,为此要加强以责任保护权益,细化规则,补缺补漏,加快警察代表机关和公共关系机构建设,明确职权职责,提高警察的职业化程度。The shape of the protection system of the rights and interests of Chinese police has gone through the following three steps： formation, development and promotion. From the administrative adjustment to the legal regulation, protecting with the power to protecting with the responsibility, granting rights （power） to providing relief, protecting after the event to protecting in advance, internal protection to social protection, the protection of specialized agencies and direction would be achieved gradually. However, there are still many deficiencies. In terms of the sources of law, the legislative level is very low and the norms are scattered, so we should uniform legislation and legislate ＂ Regulations on Protection of Rights and Interests of The Police＂. In terms of the contents of the legislation, there are many remaining gaps and lack of maneuverability, we should strengthen the responsibility, clarify the rules and speed up the construction of the police and public relations agencies, as well as improving the police＇s professional- ization degree.
