西部农村农用地流转:权益矛盾及调处

摘　　要：西部农村农用地流转,在乡镇政府、村委会、农户以及外来业主等权利主体之间,存在着流转主体、合同期限、面积认定、利益分配、法律限制、政府优惠等多方面的权益矛盾。能动适用相关法律,妥善调处各方矛盾,实现各方共存双赢,才能保证西部农村农用地有序流转,促进当地经济发展。In the transfer of agro-land in western China, there are such contradictions of rights and benefits among the township governments, village committees, farmers and leaseholders in terms of the transfer of the subject, the lease time, the accuracy of the area, the allocation of interests, the legal regulations and the government＇s favorable policies. The proper transfer of such land and the local economic development as well as their mutual benefits rely on the proper application of the laws and the clever handling of the contradictions.
