日本裁判员制度的创设与证据法的变动

摘　　要：尽管将于2009年5月21日开始实施的《裁判员法》没有对证据制度作出修改,但裁判员制度的采用将间接地改变原来的证据法。本文从自白规则以及传闻证据两个方面就裁判员制度的创设给日本证据法运用带来的变化进行了阐述,并对未来进行了展望。Although no change is made to the evidence system in the new Jury Law, which will be effective as of May 21, 2009, the adoption of the Saiban-in System （Japanese new jury system） will definitely leave indirect impact on the evidence law of Japan. This paper, from the perspectives of rules of confession and hearsay evidence, elaborates on the possible change made to the application of evidence law in Japan by the new system, and presents a future outlook.
