农村家庭联产承包责任制的土地流转研究

摘　　要：从法律关系的主体、客体和内容等方面分析了《农村土地承包法》在农地流转相关规定上存在的缺陷,提出了相应的完善建议。现行《农村土地承包法》的农地流转机制并非市场机制,难以实现承包土地的有效自由流转,主张在不改变土地承包关系的前提下,创设"土地银行",联结农业用地的"存、贷"双方,建立与市场经济相适应的土地流转机制,完善农村家庭联产承包责任制,以解决现代农业发展,农民增收和农业剩余劳动力转移问题。The paper analyzes the flaws on land circulation rules in Law of Rural Land Responsibility System, in terms of principal, object and content of legal relationship and thus proposes better suggestions. The land circulation system in active Law of Rural Land Responsibility System is not a market system, under which the land is hard to circulate effectively and freely. The paper asserts to set up Bank of Land, connect the debit part and credit part of rural land, build land circulation system that adapts to market economics, and perfect household responsibility system, given keeping the relationship of land responsibility, so as to develop modem agriculture, raise peasants＇ revenue and solve the problem of rural labor surplus transfer.
