摘　　要：目前,我国监护法律制度还很不完善,对未成年人监护只规定了法定监护和指定监护制度,没有规定遗嘱监护和委托监护制度;现行法律规定作为指定监护的指定机关在运作实践中遇到许多问题;立法上有关监护产生的原因和监护的变更、终止事由与程序规定均不明确。这些均需要在制定我国《民法典》时进一步加以充实与完善,以充分发挥未成年人监护制度应有的作用。The guardianship system of China remains to be perfected, since there are only systems of guardianship by statute and by appointment without systems of guardianship by testament and by entrustment. At the same time, the appointed agencies for guardianship meet problems in practice, and the regulations on causes, alteration, termination and procedure for guardianship are not clear. Therefore, our guardianship system should be improved when making Civil Code of China to fully display the role of the system for minors.
