实施名牌战略背景下完善我国知识产权法律制度的思考

摘　　要：为支持与保障名牌战略的实施,从名牌所具备的高质量与高知名度两个核心特征出发,必须加强我国知识产权法律制度建设。完善我国专利法律制度及专利发展战略,加强专有技术、商业秘密的保护是名牌所指向产品实现高质量的内在要求;完善我国商标法等商业标志法律制度,尽快制定统一商业标志法是保障名牌高知名度必然的制度要求。此外,为促进名牌战略的持续健康发展,还需完善我国竞争法律制度,重视商誉法律保护制度的建设,完善标准化中的知识产权法律制度,鼓励企业引进或制定技术标准,为企业名牌建设提供技术标准服务。It is necessary for implementing the eleventh five-year plan development to make a point of brand building. It is one of important strategies to implement name brand for the social economic development in our country. In order to support and ensure the implementation of name brand, it must be strengthened to construct the legal system of intellectual property in view of the two characteristics of high quality and high popularity for name brand. Perfecting the legal system and development strategy of patent, as well strengthening the protection of special technique and commercial secret are the inner requirement of realizing the high quality of products pointing by name brand. Perfecting the legal system of commercial mark such as trademarks, as well establishing the law of uniform commercial mark as soon as possible is inevitable system requirement to ensure the popularity of name brand. In addition, in order to accelerate the continuous and healthy development of name brand strategy, it is necessary to further perfect the competition legal system, to pay attention to construct commercial honor law system, to perfect standard legal system of intellectual property, to encourage enterprises to introduce and establish technical standard, and to provide technical standard service for construction of enterprise name brand.
