摘　　要：文章阐述了海外投资保险立法的涵义和价值,分析了中国海外投资现状及海外投资保险立法中存在的问题,考察了可资借鉴的美国式双边主义、日本式单边主义和联邦德国式混合主义的海外投资保险立法模式及其内容。最后,从立法模式、承保机构设置、保险范围、保险对象、投保人、代位求偿权的视角,对完善中国海外投资保险立法的对策及建议进行了探讨。The paper elaborates the meaning and value of overseas investment insurance legislation. It analyzes the present situation of China＇s overseas investment and the problems in overseas investment insurance legislation such as the existing legislative pattern waiting for restructuring, the imperfect establishment of insurance organizations, the insurance coverage waiting for adjusting, the incomplete qualified standard for insured objects, the loose scope limit for policy holder as well as the unclear stipulation for enjoying and exercising the right of subrogation and so on. It investigates the legislation patterns and contents of American bilateral doctrine style, Japanese unilateralism style, and German mixed principle style as sources of references. Finally, from the perspectives of legislative pattern, insurance organizational establishment, insurance coverage, insured object, policy holder and the right of subrogation, it discusses and studies the countermeasures and suggestions for perfecting China＇s overseas investment insurance legislation.
