摘　　要：一起看似简单的投标纠纷,可能隐含着不可告人的交易。商业贿赂在重拳治理下出现新的变种。假借招标投标和集体决策的合法外衣,仍然可以达到规避法律、获取私利的目的。在治理商业贿赂过程中,我们又面临立案难、举证难和认定难等诸多难题。当务之急就是要针对实践中存在的难题,采取对症下药的措施,立法完善首当其冲。The bid appears to be a simple dispute, possibly involved in a hidden secret deal. It is commercial bribery under the strict control of the new variant. Bidding under the guise of legitimate and collective decision-making coat, can still be reached to circumvent the law, access to private interests.
