科学发展观与中国行政法本体论的重构

摘　　要：行政法以国家理论和政治理论为基础。科学发展观是现阶段中国特色社会主义的国家理论和政治理论。本文认为,要构建中国特色的行政法,当以科学发展观为基础,以权力与权利为核心,实现它们之间的互动与平衡,重构中国行政法的本体论。Administrative law is based on the state and political theory, and the scientific outlook on development is the state and political theory with Chinese characteristics at the current time. To build the system of administrative law with Chinese characteristics, the article argues, we should strive to reconstruct the ontology of China＇ s administrative law on the basis of the scientific outlook on development, laying emphasis on the interaction and balance between power and right.
