摘　　要：所谓前科消灭制度是指具有前科的人经过法定程序被宣告注销犯罪记录,恢复正常法律地位的一种制度。在我国刑事法律中应确立前科消灭制度。在立法时,应在对象条件、时间条件、行为表现条件上加以限制,并明确规定前科消灭的程序和法律后果。The prior conviction system means the person with prior conviction is declared that the crime record cancelled by the due course of law. It is a legal system of resuming the normal legal status. The prior conviction elimination system should be established in our country＇s criminal taw. In legislation, the object terms, time terms, behavior performance terms should be restricted, and the procedure of the prior conviction elimination system and its legal consequence should be stipulated clearly.
