中国音乐作品著作权集体管理制度的现状与未来

摘　　要：中国音乐作品的著作权集体管理制度在保护著作权人和邻接权人的利益方面发挥了重要的作用,但该制度尚存在一些立法上的缺陷,著作权集体管理组织与作品使用者和政府部门的沟通不够,相关研究人才和实务人才也非常缺乏。今后我国应当注重学习国外的先进经验,从立法上和执法上来完善该制度,并加强著作权集体管理组织与作品使用者及政府部门之间的沟通,大力培养相关的研究人才和实务人才,培养公众知识产权保护意识。The system of collective administration on musical works in China has played an important role in protecting the interests of owners of copyright and neighbor right. However, it still has some defects in legislation, and collective administrative organizations of copyright and its users do not communicate sufficiently with governmental agencies, and relevant experts in its research and practice are extremely lacking. In the future we shall stress learning advanced experience from foreign countries, improving the system from the perspective of legislation and enforcement, strengthening the communication between collective administrative organizations of copyright and its users and government agencies, making great effort to train competent personnel in relevant research and practice, and fostering the consciousness of intellectual property right protection of the public.
