破坏自然资源犯罪构成特征及其视点探究

摘　　要：大多数学者论述环境犯罪都是以污染环境犯罪为例,并且涵盖了破坏自然资源保护犯罪,这种现象可能导致破坏自然资源保护犯罪中一些潜在的问题无法提升至法理层面进行探讨。基于破坏自然资源与污染环境两种类型犯罪的构成特征比较,指出破坏自然资源犯罪探究视点,以期引起学界关注和探讨。Most of scholars take destroying natural resources crime as a part of environmental pollution crime for granted.Such phenomenon can cause some potential problems that can not be made an inquiry into legal principle. Based on constitutive feature of the two kinds of environmental crime , the paper point out discussing focus in order of the advanced inquiry.
