摘　　要：传统以法律预防为目的的刑罚目的理论在应用时由于刑事法治的问题产生了一系列的难题。而社会防卫的刑罚目的可以有效解决和补充法律预防的弊端,完善刑事法治。而社会防卫的刑罚目的对刑事立法和司法实践提出了新的要求。Traditional theory of purpose of legal prevention causes a lot of problems because of the problems of criminal nile of law. But the theory of purpose of social defense can solve effectively and implement the shortcomings of legal prevention, improve the criminal rule of law. Furthermore the theory of purpose of social defense proposes new demands to the criminal legislation and judicial practice.
