农村社区集体主体问题研究——以农民集体土地所有权为例剖析

摘　　要：农村社区集体主体问题无论从理论上还是实践中来说都是一个相对复杂的问题,它牵涉到农村集体制度问题的方方面面,是一个重要的值得研究的问题。本文立足于理论与实践的结合,从现行农村社区集体主体的现状剖析入手,对农村社区集体财产权、农村社区集体财产权主体、农村社区集体组织多个法人共存等问题作出了阐述和分析,提出了农村社区集体主体重构和内部治理机构完善的对策建议:(1)一定社区范围内的三个农村集体主体变为一个农村集体主体——农民集体;(2)法律应赋予农民集体之特殊民事主体法律地位——非法人团体;(3)农村社区三级集体组织体系变为一级集体组织体系——村农民集体;(4)完善村农民集体内部治理机构——村"成员大会"或者"成员代表大会",村"经营管理委员会",村"成员自治监督委员会"。Rural community collective main body is a complicated problem concerning the aspects of rural collective ownership and hence deserves in-depth scrutiny in terms of both theory and practice. This study firstly analyzed the three-level （township, village and group） property of rural community, diversification of collective main bodies （the main body of rural community collective poverty right, the rural collective economic organization and the rural villagers autonomy organization） and their status in quo. Then several problems were penetrated into from the legal perspectives ： e.g. the chaos in legislation triggered off and ignited by the ambiguous legal poverty of rural collective poverty rights, and the phantom or absence of the main body of rural collective poverty rights. Finally, some countermeasures and suggestions were put forward to reconstruct the collective main body of rural community and consummate the internal governance framework： （1） To convert the three main bodies into one -farmers collective ; （2） To endow farmers＂ collective with special civil main body legal status-non-body corporate; （3）To change the three-level collective organization system into one-level-village; （4）To improve the internal governance framework of farmers collective-membership convention or committee, and membership autonomous suoervision committee. villagers congress, village management
