农村法治建设探论

摘　　要：探讨了我国现代化进程中的农村法治建设问题。指出由于国家制度供给、国家发展模式与资源配置、农村社会结构、历史传统等方面因素的影响,目前农村法治建设仍然存在农民的主体地位没有确立、法治的平等精神缺失、农村法律制度不健全等突出问题。认为农村法治的未来发展宜采用政府主导推进型模式,在政府领导下通过各种具体制度的建构来促进农村法治的发展。The construction of rule of law in rural areas plays an important role in China＇ s modernization process. However, due to the impact of some factors, such as national system supply, national development model and allocation of national resources, and the rural social structure, history and tradition, there arc still some obvious problems like the unestablishment of the dominant status of peasantry, the missing of the spirit of equality of rule of law, the imperfection of the rural legal system, etc. The future development of the rule of law in rural areas should adopt the model of promotion mainly by government. We should promote the development of rule of law in rural areas through the construction of a variety of specific systems under the leadership of the government.
