摘　　要：雇用人责任是大陆法系的一项法律制度,英美法系称之为替代责任。随着时代的发展,两大法系中构成该项法律制度基础的雇用关系突破了固有含义的限制,雇用关系发展为事实上的使用关系。雇用人责任在我国现有法律体系中尚属空白,我国已经具备了建立该项法律制度的社会基础,虽然我国已有该项法律制度的一系列立法尝试,但尚不足以解决社会生活中的现实问题。The employer＇s liability is an important legal system in the Continental law system, the Anglo -American law system calls it the vicarious liability. Along with the time development, constituted two big law systems this law system foundation the employment relations to break through the inherent meaning limit, the employment relations development for in fact use relations. The employer＇s liability still was the blank in our country existing legal framework, our country already has has established this legal system the social basis, although our country had this legal system a series of legislations attempt, but still was insufficient to solve in the social life realistic problem.
