中国农村医疗保险立法存在的问题及对策

摘　　要：我国农村医疗保险立法存在立法滞后,缺乏超前意识;立法体系混乱,政策措施相互矛盾;中央立法少,地方立法多,立法层次低;缺乏责任规范和制裁办法,实施机制薄弱等问题。完善农村医疗保险立法应更新立法理念,树立超前的立法意识;加强中央立法,提高立法层次,完善立法体系;制定责任规范和制裁办法,强化实施机制;建立城乡一体化的覆盖全民的全国统一的社会医疗保险法。In the legislation of the rural medical insurance in our country, there exists such problems such as the lack of forward legislative sense, the disorder of legislative systems and the contradiction between and among of poticies and measures,less legislation of the central government and more legislation of the local government as well as the low level of legislation, the lack of responsibility norms and the correspondent measures, weaknesses of executive mechanisms. To perfect the legislation of the rural medical insurance, legislation concepts should be renewed and forward legislative senses established;the legislation of the central government showld be strengthened, the legislative level should be improved and the corresponding systems perfectde;responsibility norms and countermeasures should be constituted and executive systems enforced;the intigration system of cities and countrysides should be established.
