摘　　要：通过对劳动教养制度弊端的分析,指出应当废除这一不合理且违反宪法的制度。在比较各种替代方案的基础上,肯定了司法化方案,并对正在起草的违法行为矫治法提出立法建议。This essay points out that the reeducation -through -labor system, which is unreasonable and unconstitutionally, should be abolished through an analysis of its defaults. On the basis of a eomparison among the substitutive systems, the author insists on the judicial method and put forward legislative suggestions for rehabilitation act for illegal activities.
